1. The service and who provides it

LabelCheck is an AI-assisted review of cosmetic label compliance for the EU and UK markets, provided by Nicodemo & Signa Company Srl, Strada Lucian Blaga nr. 21, ap. 16, Arad, Romania, VAT RO15617609. Contact: info@cosmetifull.com. LabelCheck is a professional tool for businesses (B2B); by creating an account you confirm you use it in the course of a business activity.

2. What LabelCheck is, and what it is not

LabelCheck assists, it does not certify. Results are generated by an artificial intelligence system, are purely informational and may contain errors or omissions. They do not constitute legal advice, do not replace the assessment of a qualified professional and do not represent the position of any authority. Responsibility for product compliance remains with the economic operator and the Responsible Person under Regulation (EC) No 1223/2009.

Interactions with the LabelCheck assistant are interactions with an AI system, not with a human operator.

3. Beta access

LabelCheck is currently offered in a beta phase, on request and subject to approval. During the beta: features may change or be interrupted, availability is not guaranteed, and access conditions (including any fees) are those agreed with you at approval. We may update these terms as the service evolves; substantial changes will be notified in the app.

4. Your account

You agree to provide accurate information at registration, keep your credentials confidential and notify us of any unauthorized use. Accounts belong to the company named at registration; company accounts share access to the company's analyses among approved members.

5. Your content

The labels, texts and documents you upload remain yours. You grant us the rights needed to process them for providing the service (analysis, storage in your account, translations you request). You confirm you are entitled to submit the materials you upload. We treat your uploaded materials as confidential and do not share them with third parties except the processors listed in the Privacy Policy, acting on our instructions.

6. Aggregated data

We may derive aggregated, anonymized statistics from analyses (issue types, severity, markets, languages), in a form that never identifies you, your company, your products or the content of your materials, and use them to improve the service, for internal analysis and for sector-level statistical publications. Your content is not used to train artificial intelligence models.

7. Acceptable use

You agree not to: probe or disrupt the service's security; access other tenants' data; resell access without our written agreement; use the service to develop a competing automated product; submit content you have no right to use; or rely on the service as the sole basis for regulatory decisions.

8. Intellectual property

The service, its software, its knowledge base and its branding belong to Nicodemo & Signa Company Srl or its licensors. These terms grant you a limited, non-exclusive, non-transferable right to use the service for your business while your access is active.

9. Liability

To the maximum extent permitted by law: the service is provided "as is" during the beta; we do not warrant that results are complete, correct or fit for a specific purpose; and our total liability arising from the service is limited to the amounts you paid for it in the 12 months preceding the event (or, where nothing was paid, to EUR 100). Nothing in these terms excludes liability that cannot be excluded by law, including for intent or gross negligence.

10. Term and termination

You can stop using the service and ask us to close your account at any time. We may suspend or terminate access for breach of these terms or at the end of the beta, with notice where reasonably possible. Sections 2, 5, 6, 8, 9 and 11 survive termination.

11. Governing law

These terms are governed by Romanian law. Any dispute that cannot be settled amicably is subject to the competent courts of Arad, Romania, without prejudice to mandatory jurisdiction rules in your favour. The English version of these terms is the reference version; the Italian and Romanian versions are courtesy translations.

12. Consumer information

LabelCheck is a professional tool intended for business use. If you nevertheless use the service as a consumer under applicable law, you may be entitled to alternative dispute resolution: in Romania the competent body is ANPC (Autoritatea Națională pentru Protecția Consumatorilor), through the SAL procedure, anpc.ro/ce-este-sal. The former European ODR platform was discontinued by Regulation (EU) 2024/3228 and is no longer available.
